Examines literary and legal sources to document thoughts and feelings about capital punishment in the United States over the long nineteenth century. Drawing from legal and extralegal discourse but focusing on imaginative literature, Literary Executions examines representations of, responses to, and arguments for and against the death penalty in the United States over the long nineteenth century. John Cyril Barton creates a generative dialogue between artistic relics and legal history. He looks to novels, short stories, poems, and creative nonfiction as well as legislative reports, trial transcripts, legal documents, newspaper and journal articles, treatises, and popular books (like The Record of Crimes, A Defence of Capital Punishment, and The Gallows, the Prison, and the Poor House), all of which were part of the debate over the death penalty. Barton focuses on several canonical figures--James Fenimore Cooper, Nathaniel Hawthorne, Lydia Maria Child, Walt Whitman, Herman Melville, and Theodore Dreiser--and offers new readings of their work in light of the death penalty controversy. Barton also gives close attention to a host of then-popular-but-now-forgotten writers--particularly John Neal, Slidell MacKenzie, William Gilmore Simms, Sylvester Judd, and George Lippard--whose work helped shape or was shaped by the influential anti-gallows movement. Analyzing the tension between sovereignty and social responsibility in a democratic republic, Barton argues that the high stakes of capital punishment dramatize the confrontation between the citizen-subject and sovereign authority in its starkest terms. In bringing together the social and the aesthetic, Barton shows how legal forms informed literary forms and traces the emergence of the modern State in terms of the administration of lawful death. By engaging the politics and poetics of capital punishment, Literary Executions contends that the movement to abolish the death penalty in the United States should be seen as an important part of the context that brought about the flowering of the American Renaissance during the antebellum period and that influenced literature later in the nineteenth and early twentieth centuries.

Amid rising public concern about the proliferation and privatization of prisons, and their promise of enormous profits, world-renowned author and activist Angela Y. Davis argues for the abolition of the prison system as the dominant way of responding to America's social ills. "In thinking about the possible obsolescence of the prison," Davis writes, "we should ask how it is that so many people could end up in prison without major debates regarding the efficacy of incarceration." Whereas Reagan-era politicians with "tough on crime" stances argued that imprisonment and longer sentences would keep communities free of crime, history has shown that the practice of mass incarceration during that period has had little or no effect on official crime rates: in fact, larger prison populations led not to safer communities but to even larger prison populations. As we make our way into the twenty-first century-two hundred years after the invention of the penitentiary-the question of prison abolition has acquired an unprecedented urgency. Backed by growing numbers of prisons and prisoners, Davis analyzes these institutions in the U.S., arguing that the very future of democracy depends on our ability to develop radical theories and practices that make it possible to plan and fight for a world beyond the prison industrial complex.

From a leading prison abolitionist, a moving memoir about coming of age in Brooklyn and surviving incarceration--and a call to break free from all the cages that confine us.   Marlon Peterson grew up in 1980s Crown Heights, raised by Trinidadian immigrants. Amid the routine violence that shaped his neighborhood, Marlon became a high-achieving and devout child, the specter of the American dream opening up before him. But in the aftermath of immense trauma, he participated in a robbery that resulted in two murders. At nineteen, Peterson was charged and later convicted. He served ten long years in prison. While incarcerated, Peterson immersed himself in anti-violence activism, education, and prison abolition work.   In Bird Uncaged, Peterson challenges the typical "redemption" narrative and our assumptions about justice. With vulnerability and insight, he uncovers the many cages--from the daily violence and trauma of poverty, to policing, to enforced masculinity, and the brutality of incarceration--created and maintained by American society. Bird Uncaged is a twenty-first-century abolitionist memoir, and a powerful debut that demands a shift from punishment to healing, an end to prisons, and a new vision of justice.

Changes in the American religious landscape enabled the rise of mass incarceration. Religious ideas and practices also offer a key for ending mass incarceration. These are the bold claims advanced by Break Every Yoke, the joint work of two activist-scholars of American religion. Once, in an era not too long past, Americans, both incarcerated and free, spoke a language of social liberation animated by religion. In the era of mass incarceration, we have largely forgotten how to dream-and organize-this way. To end mass incarceration we must reclaim this lost tradition. Properly conceived, the movement we need must demand not prison reform but prison abolition. Break Every Yoke weaves religion into the stories about race, politics, and economics that conventionally account for America's grotesque prison expansion of the last half century, and in so doing it sheds new light on one of our era's biggest human catastrophes. By foregrounding the role of religion in the way political elites, religious institutions, and incarcerated activists talk about incarceration, Break Every Yoke is an effort to stretch the American moral imagination and contribute resources toward envisioning alternative ways of doing justice. By looking back to nineteenth century abolitionism, and by turning to today's grassroots activists, it argues for reclaiming the abolition "spirit."

Building Abolition: Decarceration and Social Justice explores the intersections of the carceral in projects of oppression, while at the same time providing intellectual, pragmatic, and undetermined paths toward abolition. Prison abolition is at once about the institution of the prison, and a broad, intersectional political project calling for the end of the social structured by settler colonialism, anti-black racism, and related oppressions. Beyond this, prison abolition is a constructive project that imagines and strives for a transformed world in which justice is not equated with punishment, and accountability is not equated with caging. Composed of sixteen chapters by an international team of scholars and activists, with a Foreword by Perry Zurn and an Afterword by Justin Piché, the book is divided into four themes: Prisons and Racism; Prisons and Settler Colonialism; Anti-Carceral Feminisms; Multispecies Carceralities.

Since first published in 2011, Captive Genders, a groundbreaking account of trans and genderqueer people within the prison industrial complex, has become a highly regarded resource and valuable touchstone for incarcerated LGBTQ people and their allies. The first book of its kind, it has been highly praised by gender theorists and prison abolitionists alike, including Angela Davis. This book draws together the work of a new community of scholars with a growing interest in carceral geography. It combines work by geographers on 'mainstream' penal establishments where people are incarcerated by the prevailing legal system, with geographers' recent work on migrant detention centres, where irregular migrants and 'refused' asylum seekers are detained ostensibly pending decisions on admittance or repatriation. This book presents a timely addition to emergent interdisciplinary scholarship that will prompt dialogue among those working in geography, criminology and prison sociology.

Contesting Carceral Logic provides an innovative and cutting-edge analysis of how carceral logic is embedded within contemporary society, emphasizing international perspectives, the harms and critiques of using carceral logic to respond to human wrongdoing, and exploring penal abolition thought. With chapters from scholars across many disciplines, people in prison, as well as penal abolition activists, the book explores what a future without carceral logic would look like, as well as how such a future is to be developed. The book is also an exploration of penal abolition thought as it is developing in the twenty-first century. Diverse geographical, cultural, identity and experiential frames inform the book's themes of analysing carceral logic as it harms disparate people in disparate places, creating anti-carceral knowledge, exploring case studies pointing to radical alternatives, and to contesting carceral logic from below. Ultimately, Contesting Carceral Logic provides the reader with an alternative and critical perspective from which to reflect on carceral logic, the punitive state and the criminalizing systems that almost exclusively dominate across the world. Finally, it raises the questions of how we are to build communities as well as transform our response to human wrongdoing in ways that are not defined by racism/ethnocentrism, class war and heteropatriarchy.

This vital addition to carceral, prison, and disability studies draws important new links between deinstitutionalization and decarceration   Prison abolition and decarceration are increasingly debated, but it is often without taking into account the largest exodus of people from carceral facilities in the twentieth century: the closure of disability institutions and psychiatric hospitals. Decarcerating Disability provides a much-needed corrective, combining a genealogy of deinstitutionalization with critiques of the current prison system. Liat Ben-Moshe provides groundbreaking case studies that show how abolition is not an unattainable goal but rather a reality, and how it plays out in different arenas of incarceration--antipsychiatry, the field of intellectual disabilities, and the fight against the prison-industrial complex. The United States leads the world in incarceration, and the United Kingdom is persistently one of the European countries with the highest per capita rates of imprisonment. Yet despite its increasing visibility as a social issue, mass incarceration - and its inconsistency with core democratic ideals - rarely surfaces in contemporary Anglo-American political theory. Democratic Theory and Mass Incarceration seeks to overcome this puzzling disconnect by deepening the dialogue between democratic theory and punishment policy. This collection of original essays initiates a multi-disciplinary discussion among philosophers, political theorists, and criminologists regarding ways in which contemporary democratic theory might begin to think beyond mass incarceration. Recent years have seen an explosion of protest and concern about police brutality and repression--especially after long-held grievances in Ferguson, Missouri, erupted in months of violent protest following the police killing of Brown. Much of the conversation has focused on calls for enhancing police accountability, increasing police diversity, improving police training, and emphasizing community policing. Unfortunately, none of these is likely to produce results, because they fail to get at the core of the problem. The problem is policing itself--the dramatic expansion of the police role over the last forty years. This book attempts to jog public discussion of policing by revealing the tainted origins of modern policing as a tool of social control and demonstrating how the expanded role of the police is inconsistent with community empowerment, social justice--even public safety. Drawing on first-hand research from across the globe, Alex Vitale shows how the implementation of alternatives to policing, like drug legalization, regulation, and harm reduction instead of the policing of drugs, has led to reductions in crime, spending, and injustice.

Over the last thirty years, the U.S. penal population increased from around 300,000 to more than two million, with more than half a million prisoners returning to their home communities each year. What are the social costs to the communities from which this vast incarcerated population comes? And what happens to these communities when former prisoners return as free men and women in need of social and economic support? In Imprisoning America, an interdisciplinary group of leading researchers in economics, criminal justice, psychology, sociology, and social work goes beyond a narrow focus on crime to examine the connections between incarceration and family formation, labor markets, political participation, and community well-being. The book opens with a consideration of the impact of incarceration on families. Using a national survey of young parents, Bruce Western and colleagues show the enduring corrosive effects of incarceration on marriage and cohabitation, even after a prison sentence has been served. Kathryn Edin, Timothy Nelson, and Rechelle Parnal use in-depth life histories of low-income men in Philadelphia and Charleston, to study how incarceration not only damages but sometimes strengthens relations between fathers and their children. Imprisoning America then turns to how mass incarceration affects local communities and society at large. Christopher Uggen and Jeff Manza use survey data and interviews with thirty former felons to explore the political ramifications of disenfranchising inmates and former felons. Harry Holzer, Stephen Raphael, and Michael Stoll examine how poor labor market opportunities for former prisoners are shaped by employers' (sometimes unreliable) background checks. Jeremy Travis concludes that corrections policy must extend beyond incarceration to help former prisoners reconnect with their families, communities, and the labor market. He recommends greater collaboration between prison officials and officials in child and family welfare services, educational and job training programs, and mental and public health agencies. Imprisoning America vividly illustrates that the experience of incarceration itself--and not just the criminal involvement of inmates--negatively affects diverse aspects of social membership. By contributing to the social exclusion of an already marginalized population, mass incarceration may actually increase crime rates, and threaten the public safety it was designed to secure. A rigorous portrayal of the pitfalls of getting tough on crime, Imprisoning America highlights the pressing need for new policies to support ex-prisoners and the families and communities to which they return.

The breadth and impact of Black Lives Matter in the United States has been extraordinary. Between 2012 and 2016, thousands of people marched, rallied, held vigils, and engaged in direct actions to protest and draw attention to state and vigilante violence against Black people. What began as outrage over the 2012 murder of Trayvon Martin and the exoneration of his killer, and accelerated during the Ferguson uprising of 2014, has evolved into a resurgent Black Freedom Movement, which includes a network of more than fifty organizations working together under the rubric of the Movement for Black Lives coalition. Employing a range of creative tactics and embracing group-centered leadership models, these visionary young organizers, many of them women, and many of them queer, are not only calling for an end to police violence, but demanding racial justice, gender justice, and systemic change. In Making All Black Lives Matter, award-winning historian and longtime activist Barbara Ransby outlines the scope and genealogy of this movement, documenting its roots in Black feminist politics and situating it squarely in a Black radical tradition, one that is anticapitalist, internationalist, and focused on some of the most marginalized members of the Black community. From the perspective of a participant-observer, Ransby maps the movement, profiles many of its lesser-known leaders, measures its impact, outlines its challenges, and looks toward its future.  

Marc Mauer and Ashley Nellis of The Sentencing Project argue that there is no practical or moral justification for a sentence longer than twenty years. Harsher sentences have been shown to have little effect on crime rates, since people "age out" of crime--meaning that we're spending a fortune on geriatric care for older prisoners who pose little threat to public safety. Extreme punishment for serious crime also has an inflationary effect on sentences across the spectrum, helping to account for severe mandatory minimums and other harsh punishments. Also features profiles of a half dozen people affected by life sentences, written by former "lifer" and writer Kerry Myers.

When Dr. John Snow first traced an outbreak of cholera to a water pump in the Soho district of London in 1854, the field of epidemiology was born. Taking the same concepts and tools of public health that have successfully tracked epidemics of flu, tuberculosis and AIDS over the intervening one hundred and fifty years, Ernest Drucker makes the case that the current unprecedented level of imprisonment has become an epidemic, a plague upon our body politic.

How policing became the major political issue of our time. Drawing on philosophical arguments, criminological evidence, and the legal literature on prisoners' rights, Rethinking Imprisonment defends a normative theory of imprisonment. Such a theory provides an account of the justified conditions of prison confinement - the restrictions anddeprivations that may be legitimately imposed on serious offenders in the name of punishment. The theory of legal punishment upon which this account builds combines retributive and crime reduction elements, with the former accorded priority on both moral and epistemic grounds. Contrary to itsformidable reputation, retributivism is shown to place important and substantial limits on the character of imprisonment, its appropriate use, and duration. Much of the contemporary use of imprisonment as a legal sanction is arguably unjustified on all three counts.Rethinking Imprisonment urges the adoption of prison conditions at or near the 'minimum conditions of confinement' which severely curtail the freedom of movement, freedom of association, and privacy of prisoners, yet are still consistent with ensuring the basic physical and psychological welfare ofprisoners, and provide them with access to paid labor, visitation, entertainment, recreation, and retained civic and political rights. This book argues firstly that the punishment of serious offenders generally requires no more than the imposition of 'minimum conditions of confinement' and secondlythat moral constraints on punishment derived from retributivism in conjunction with the available evidence about the prison regimes most likely to reduce crime point towards more humane and less restrictive prisons.

In Violence Work, Micol Seigel offers a new theorization of the quintessential incarnation of state power: the police. Foregrounding the interdependence of policing, the state, and global capital, Seigel redefines policing as "violence work," showing how it is shaped by its role of channeling state violence. She traces this dynamic by examining the formation, demise, and aftermath of the U.S. State Department's Office of Public Safety (OPS), which between 1962 and 1974 specialized in training police forces internationally. Officially a civilian agency, the OPS grew and operated in military and counterinsurgency realms in ways that transgressed the borders that are meant to contain the police within civilian, public, and local spheres. Tracing the career paths of OPS agents after their agency closed, Seigel shows how police practices writ large are rooted in violence--especially against people of color, the poor, and working people--and how understanding police as a civilian, public, and local institution legitimizes state violence while preserving the myth of state benevolence.
